Warranty and Liability Clause

Please note: If the product was not purchased from an authorized dealer in South Africa, AXOR Helmets South Africa, its affiliated companies, and/or partners will not be liable for any warranty, claims, or liabilities.

Proof of purchase is required to qualify. Only the original customer will be covered by this warranty and return policy.

Overview:

If you're not fully satisfied with your purchase, you are welcome to return the product(s) in accordance with the terms outlined here, as well as your rights under the Consumer Protection Act (CPA) 68 of 2008 and the Electronic Communications and Transactions Act (ECT) 25 of 2002.

The Return Policy is part of our Terms of Use, where defined terms hold the same meaning unless otherwise stated. This Policy is not intended to limit or affect your statutory rights in any way.

Returns & Exchanges:

If you would like to exchange a product, please inform us by email at orders@Axorhelmets.co.za within 7 (seven) days of receiving or collecting your order. We will happily exchange the product or refund the purchase price, as long as the product meets the following conditions:

·         Undamaged, unworn, and unused, with the original labels and stickers still attached.

·         In its original packaging, which must be undamaged and with all seals intact.

·         Complete, with no missing parts or accessories; and

·         Not listed as a non-returnable item below.

·         Returns accepted for 7 days

·         Customer provides return shipping

·         No restocking fee

·         No final sale items

Please be aware that the cost of shipping the returned item to us, as well as the cost of sending a replacement (if applicable), will be your responsibility.

After we inspect the product and approve the return, we will proceed with the exchange or refund. The refund, equal to the purchase price, will be processed within 10 (ten) working days of receiving the returned item.

Non- Returnable Products:

Due to public health, hygiene, or regulatory reasons, the following items cannot be returned unless pre-approved in writing by an authorized representative of AXOR® Helmets South Africa:

·         Products that have been customised or personalised in any way disassembled, altered, or combined with other items.

·         Undergarments, bodywear, bodysuits, masks, or worn helmets.

·         Discounted, sale, or clearance items.

·         Alternative products that have been fitted to another item after delivery or collection.

Incorrectly Supplied Products:

If an incorrect product was delivered to you by mistake, please notify us immediately or within 7 (seven) days of receiving your order. We will arrange for the product to be collected at no cost to you and will replace, exchange, or refund it within 10 (ten) working days of receiving the returned item. (The same conditions outlined in our return policy will apply)

Products Damaged in Transit:

We adhere to global shipping standards and take care to package our parcels accordingly. However, there may be instances where your product is damaged due to circumstances beyond our control. Therefore, we request that you:

1.       Inspect the parcel and document any significant damage to the packaging before removing the product.

2.       Once removed, inspect the product and, if necessary, document any minor or major damage.

3.       Notify us immediately or within 24 hours of receiving your order.

Upon receiving a valid claim, we will arrange for the collection of the damaged product at our expense and will either replace, exchange, or refund the item within 10 (ten) working days of receiving it.

Standard Warranty: 

AXOR® helmets have been meticulously designed and crafted to fully meet your satisfaction. When you select an AXOR® helmet for its style, design, comfort, and safety, please ensure you follow all safety guidelines while using your motorcycle.

AXOR® provides a 1-year warranty on all helmets against manufacturing defects.

This one-year warranty is granted to the buyer from the date of purchase. It is necessary to keep the purchase invoice. An additional 2-year warranty is available upon registering your helmet with AXOR® Helmets South Africa within 30 days of purchase on the Axorhelmet.co.za website.

Exclusions:

Only material or manufacturing defects are covered under this warranty. AXOR® Helmets cannot be held responsible for the product in the following cases:

Any damage resulting from:

  1. A fall or an accident
  2. Technical modifications made by the user or a third party (e.g., glue, adhesives, paint, screws, etc.)
  3. Use of or contact with harmful chemicals (including methylated spirits on screen treatments) or exposure to significant heat sources
  4. Improper use, such as abnormal conditions (e.g., aquatic use), lack of maintenance, or care
  5. Aging due to normal wear and tear of internal fabrics and foams, or the appearance of external parts or the screen (e.g., scratches)
  6. Abnormal and prolonged exposure to UV, particularly affecting the colors of the decorations
  7. Damage to the UV coating on the visor due to usage
  8. Paint damage caused by the user sitting on the helmet.
  9. Helmet Accessories are not covered under warranty

Fluorescent colors (paints and/or decorations) on certain models in the AXOR® Helmets range may fade over time with repeated exposure to outside elements, which is not considered a defect. AXOR® Helmets recommends that you store it in a dark place and avoid prolonged direct or indirect exposure of your helmet to UV rays

Much care is taken in the hand-finishing of our helmets. Variations in appearance, tints, or paintwork do not represent faulty workmanship and therefore cannot be claimed under warranty.

AXOR® Helmets cannot accept as defects covered by the warranty any subjective issues arising from use, such as problems with comfort, size, noise or whistling, aerodynamics, etc. AXOR® Helmets is not responsible for the temporary unavailability of a helmet when it is required for upgrades to satisfy the owner.

The maximum warranty period is 3 -years, (if registered within 30 days of purchase from authorised dealer) and the replacement of any element during this time does not extend this period.

Axor® makes all efforts to supply its re-sellers with only quality finished products. However, due to market conditions, products at reseller outlets may sometimes suffer minor cosmetic damage. This kind of damage is not a manufacturing defect and is not covered under warranty. Customers are therefore advised to check the products thoroughly at the time of purchase at the sales point. Axor® cannot be held responsible for cosmetic damages found after the purchase.

Successful Replacement Claim Limit:

If AXOR® Helmets is unable to provide repairs due to technical reasons or component unavailability, AXOR® Helmets commits to offering advantageous conditions for the customer. This includes providing an identical new helmet or an equivalent model if the previous model is no longer available, considering the obsolescence of the helmet.
